Terms of service

1. Who you are agreeing with

O.I.I, also written Options Indicator Index, is operated by [ENTITY] ("O.I.I", "we", "us"). These terms apply to this website, the O.I.I Discord server, and every pick, score, lookup or message we deliver through either. Using any of it means you accept these terms. If you do not accept them, do not use the service.

2. What O.I.I is, and what it is not

O.I.I scans a list of US-listed equities each delivery night, scores each name with a technical model, and sends subscribers a small number of specific options contracts drawn from the names that clear a threshold. That is the entire product.

O.I.I is not, and does not act as:

• a registered investment adviser, broker-dealer, or futures commission merchant;
• your fiduciary, or anyone owing you a duty of care in respect of your money;
• a provider of personalized investment, legal, accounting or tax advice.

What we publish is educational analysis of publicly available market data. It is general in nature and identical for every subscriber in a tier. It is not tailored to your finances, your goals, your risk tolerance or your tax position, and we do not know any of those things about you. A pick is a contract we think is interesting given a model output. It is not a recommendation that you, in your circumstances, should buy it.

You place every order yourself. O.I.I has no access to any brokerage account of yours, executes nothing on your behalf, holds no client funds and holds no positions of yours. You decide which picks you act on, at what size, and when to close them.

3. Risk

Options trading carries a substantial risk of loss and is not suitable for every investor. Every recommendation we send is a long single-leg options position, and the most you can lose on one is the entire premium you pay for it. That total loss is a normal outcome, not an unusual one, and it happens on setups that scored well.

No outcome is promised, projected or implied. Past performance does not guarantee future results. Any figures shown on this site describing how the model works are illustrative examples, not records of past recommendations, unless a page states plainly that they are a record and identifies whether the trades were real or simulated.

You should not commit money you cannot afford to lose entirely.

4. Eligibility

You may use O.I.I only if you:

• are at least 18 years old;
• can form a binding contract where you live;
• are not barred from using the service under any applicable law or sanctions program;
• hold, or can open, a brokerage account with options trading approved.

O.I.I is built around US-listed equities and US market hours. We do not represent that the service is appropriate or available anywhere in particular, and if you use it from outside the United States you do so on your own initiative and are responsible for complying with your local law.

5. Accounts, Discord, and delivery

Access is delivered through Discord. You need a Discord account, and you are subject to Discord's own terms as well as these. Your access level in our server is what determines what you receive, so keeping your account linked and in good standing is your responsibility.

Picks are delivered Sunday through Thursday evenings, US Eastern time. We do not guarantee delivery on any given night. On nights when few names clear the model's threshold we deliver fewer picks and say so, rather than filling the count with names we would not otherwise send. If a technical failure, an outage at a data provider, at Discord, or at any other third party prevents delivery, that is not a breach of these terms and does not entitle you to a refund of that period, though we will always tell you what happened.

6. Subscriptions, billing and cancellation

Paid tiers are billed monthly or annually in advance through our payment processor. Prices are in US dollars and are shown on this site before you buy. Your subscription renews automatically at the end of each billing period until you cancel it.

You can cancel at any time, and cancellation stops the next renewal. Cancellation, refunds and what happens to your access afterward are set out in full on our refunds and cancellation page, which forms part of these terms.

We may change prices. If we do, the new price applies from your next billing period and we will give you notice by email before it takes effect, so you can cancel first if you want to.

7. Acceptable use

The picks are the product. What you may not do is redistribute them. Specifically, you agree not to:

• share, resell, republish, forward or syndicate picks, scores, lookups or any other O.I.I output to anyone who is not a subscriber, including by screenshot, copy-paste, mirror channel, group chat, newsletter or automated relay;
• share your Discord account or access with another person;
• scrape, crawl, or use any automated means to extract output from the service, or attempt to derive the underlying model from its outputs;
• use O.I.I output as an input to a competing product, or to operate a signal service of your own;
• attempt to gain access to a tier you have not paid for, or to any system or data of ours;
• harass other members, or post content in shared channels that is unlawful or abusive.

We may suspend or terminate access immediately for a breach of this section, without a refund. Redistribution is the one that matters most: a members-only service that is public is not a service.

8. Intellectual property

The scoring model, its outputs, this website, our copy, our name and our marks belong to us. Your subscription buys you a personal, non-exclusive, non-transferable license to use the picks you receive for your own trading, for as long as your subscription is active. It does not transfer ownership of anything, and it does not survive cancellation.

Your trades are yours. We claim no interest in any position you open, and no share of any gain you make.

9. Third parties

O.I.I depends on services we do not control: market data providers, Discord, our payment processor, and our hosting provider. We choose them carefully and we are not responsible for their acts, outages, errors or omissions. Market data may be delayed, incomplete or wrong, and a pick built on bad data is a risk you accept by using the service.

10. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, error-free, or that any score, pick or piece of data will be accurate or profitable.

11. Limitation of liability

To the fullest extent permitted by law, O.I.I and its operators are not liable for any trading losses, lost profits, lost opportunity, or any indirect, incidental, special, consequential or punitive damages arising out of your use of the service, whether or not we were advised such damages were possible.

Our total aggregate liability to you for any claim relating to the service is limited to the amount you actually paid us in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability for fraud or for anything else that cannot lawfully be limited.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense, including reasonable legal fees, arising from your use of the service, your trading decisions, your breach of these terms, or your violation of any law or third-party right.

13. Termination

You can stop using O.I.I at any time by cancelling. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we discontinue the service. If we discontinue the service outright, we will refund the unused portion of any period you have prepaid.

14. Changes to these terms

We may update these terms. The "last updated" date at the top of this page always reflects the current version. If a change is material we will give notice by email or in the Discord server before it takes effect. Continuing to use the service after that means you accept the new version.

15. Governing law

These terms are governed by the laws of the State of [STATE], without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in [STATE], and you consent to their jurisdiction.
